  • The United States Equal Employment Opportunity Commission (EEOC) and Circle Stores as well as Mac’s Convenience Stores, LLC (collectively referred to as “Circle K”) have entered into a settlement agreement, which provides a fund for payment to individuals who may have had a medical condition and/or were pregnant during their employment with Circle K. The settlement does not constitute an admission by Circle K of any wrongdoing, and Circle K denies that it engaged in any such conduct or unlawful action.

  • If you received a notice, it is because company records indicate you may be eligible to receive a payment.

  • If you are a current or former employee of Circle K who sought a reasonable accommodation such as leave for a disability and/or pregnancy, and were terminated at some period between July 10, 2009, and September 26, 2022, you may be eligible to receive a payment in the settlement.

  • In order to receive a payment, you must have submitted a completed claim form/questionnaire by February 26, 2023. Then if you were deemed to be an “Eligible Claimant” you needed to complete, sign, and submit your Release of Claims, and W-9 forms to the Settlement Administrator, either online or by mail postmarked no later than April 18, 2024. The deadlines to submit questionnaires, Release of Claims, and W-9 forms have now passed.

    The EEOC has now completed its review of all form submissions. At the direction of the EEOC, payments to Eligible Claimants were mailed from Seattle, WA, on September 13, 2024, via Certified Mail. If no one is available to receive this mailing, the postal worker will leave a note that a delivery attempt was made. USPS will make one delivery attempt. After that, the carrier will return this mailing to the nearest post office for collection.

  • Notices of Eligibility to Receive Payment also included a necessary tax form, and a Release of Claims form, which needed to be submitted to the Settlement Administrator no later than April 18, 2024. If forms were missing information Claimants were given an opportunity to fix those issues and resubmit their forms. 

    The EEOC has now completed its review of all form submissions. At the direction of the EEOC, payments to Eligible Claimants were mailed from Seattle, WA, on September 13, 2024, via Certified Mail. If no one is available to receive this mailing, the postal worker will leave a note that a delivery attempt was made. USPS will make one delivery attempt.     If you have not received your payment by September 30, 2024, please contact us by calling the toll-free number at 1-844-633-0691, or by email at info@EEOC-ADA-PDA-Settlement.com for instructions on how to get your check reissued.

  • Under the terms of the Settlement, the EEOC is responsible for determining awards to eligible claimants. The amount of an eligible claimant's award will be based off of objective criteria set by the EEOC, and will also depend on how many eligible claims are submitted. Eligibility Notices, with benefit estimates were sent out to Eligible Claimants on January 19, 2024. Please be sure to keep your address up-to-date with us so that you receive all future mailings. 

  • If you believe that you meet the eligibility criteria and did not receive a notice, please contact the Settlement Administrator by calling the toll-free number at 1-844-633-0691, or by email at info@EEOC-ADA-PDA-Settlement.com, to verify if a notice was sent to a different address. If you are informed that you are not on the Employee List provided by Circle K and the EEOC and believe that you meet the eligibility criteria, please send the Settlement Administrator a letter by email or mail stating as such. Please make sure to include your name, address, email address, telephone number, and approximate dates and locations of work for Circle K or Mac's.

  • At the direction of the EEOC, payments in the form of paper checks were issued to Eligible Claimants, mailed from Seattle, WA on September 13, 2024, via Certified Mail. If no one is available to receive and sign for this mailing, the postal worker will leave a note that a delivery attempt was made. USPS will make one delivery attempt. After that, the carrier will return this mailing to the nearest post office for collection.

    Awards cannot be wired, or directly deposited into accounts.

    If you are an Eligible Claimant and have not received your payment by September 30, 2024, or were not able to sign for your award, please contact us for instructions on how to get your check reissued.

  • If you were an Eligible Claimant, and were sent an award check in this matter, but you were not available to sign for it when delivery was attempted, your check was returned to your local Post Office. If you are not able to retrieve your payment from the post office, please contact us about getting your payment reissued. Please note that the reissue process can take several weeks.

  • To update your address, please send an address update request to the Settlement Administrator by email or mail. You may also request an address update through the Contact Us page of this website. Please make sure to include your name, former address, current address, and unique Claimant ID.
